Acceptable Use Policy – Artificial Intelligence

- Scope This Artificial Intelligence Acceptable Use Policy (“Policy”) applies to each Customer’s and/or authorized user’s (referred to in this Policy as “You” or “Your”) use of all services offered by GTB Technologies, Inc. or its affiliates (“GTB”) (these services constituting the “Services”), or third-party products, applications or functionality that interoperate with the Services, that incorporate any machine learning, deep learning, and other artificial intelligence technologies, including statistical learning algorithms, models (including large language models), neural networks, and other artificial intelligence tools or methodologies, including software implementations of any of the foregoing (collectively, “Covered AI Services”). Within the Covered AI Services, those that are capable of generating various types of content (including text, images, video, audio, or computer code) based on user-supplied prompts will be referred to as the “Covered Generative AI Services.” The terms of this Policy are in addition to the https://gttb.com/acceptable-use-policy/ , and are subject to and incorporate by reference the terms of GTB’s Software License and Services Agreements located at https://gttb.com/wp-content/uploads/2016/02/GTB%20Technologies%20T&C.pdf (“EULA”) and/or the applicable agreement governing the Customer and/or an authorized user’s use of the Services (the EULA and/or each other applicable agreement constituting the “Agreement”).
- Changes to Policy  GTB may change this Policy by posting an updated version of the Policy at https://gttb.com/acceptable-use-policy-ai /, without explicit notice, and the terms of the updated Policy will be effective when posted on GTB’s website. GTB is not obligated to provide notice of any revisions to this Policy.   You are responsible for reviewing and becoming familiar with any modifications. Your continued use of the Services after the effective date of the modifications will be deemed acceptance of the modified terms.   - Relationship to Data Protection Agreement (DPA)
 This Policy operates in conjunction with GTB Technologies, Inc.’s Data Protection Agreement (“DPA”) and any applicable license, subscription, or service agreement under which GTB software or services are provided (collectively, “License Agreement”). The DPA governs GTB’s processing of Customer Data in accordance with applicable privacy laws. This Policy extends those obligations to include the responsible and ethical use of GTB’s software, including any AI, NLP, or machine learning features. Nothing in this Policy modifies the DPA or expands GTB’s rights to process Customer Data beyond what is authorized under the applicable License Agreement. In the event of any conflict, the DPA and the governing License Agreement shall control.
 
- Relationship to Data Protection Agreement (DPA)
- Permitted Use. You may use the Covered AI Services only for lawful purposes and in accordance with this Policy and the Agreement. Your violation of this Policy will be considered a material breach of the Agreement.
- Prohibited Use:  You may not use a Covered AI Services, nor allow your authorized users or any third party to use a Covered AI Service, for any of the following:- Automated Decision-Making Processes with Legal Effects As part of an automated decision-making process with legal or similarly significant effects, unless you ensure that the final decision is made by a human being. In this case, you must take account of other factors beyond the Services’ recommendations in making the final decision. b. As part of an automated decision-making process for services such as, but not limited to, payday lending even when the final decision is made by a human being.
- Individualized Advice from Licensed Professionals Generating individualized advice that in the ordinary course of business would be provided by a licensed professional. This includes, for example, financial and legal advice. b. Generating or providing individualized medical advice, treatment, or diagnosis to a consumer or end user. c. For clarity, this section does not limit you from using Covered AI Services for other purposes, such as customer support in regulated industries, or to assist a licensed professional where Covered AI Services were not leveraged in the generation of individual advice. When you use such services to assist in providing individualized advice (e.g., summarization), there must be a qualified person reviewing the output.
- Explicitly Predicting Protected CharacteristicsExplicitly predicting an individual’s protected characteristic, including, but not limited to, racial or ethnic origin, and past, current, or future political opinions, religious or philosophical beliefs, trade union membership, age, gender, sex life, sexual orientation, disability, health status, medical condition, financial status, criminal convictions, or likelihood to engage in criminal acts. The previous sentence does not limit or prohibit use cases or tools designed specifically to identify security breaches, unauthorized access, fraud, and other security vulnerabilities, or to identify and reduce bias in Covered AI Services. Additionally, you may not submit images of individuals for the purposes of creating or analyzing biometric identifiers, such as face prints or fingerprints or scans of eyes, hands, or facial geometry.
- Deceptive Activity. To deceive, defraud, mislead, misinform, or disinform others, including to: impersonate any person without authorization, consent, and legal right; engage in academic dishonesty or plagiarism; distribute “spam”; or distribute or promote misinformation or disinformation.
- Child Exploitation and Abuse. Creating, sending, uploading, displaying, storing, processing, or transmitting material that may be harmful to minors including, but not limited to, for any purposes related to child exploitation or abuse, such as real or artificial Child Sexual Abuse Material (CSAM), or for engaging in, promoting, or facilitating human trafficking or sexual solicitation, exploitation, or violence.
- a. You may not deceive end users or consumers by misrepresenting content generated through automated means as human generated or original content. b. You must disclose to end users when they are interacting directly with automated systems, or similar features, unless there is a human in the loop, and when required by law, provide a means for end users to interact with a human instead of an automated system.
- Violations of Law. In any way that violates, or promotes, facilitates, or contributes to violation of, any applicable federal, state, local, or international law, ordinance, or regulation (collectively, “Laws”). Laws include, without limitation, Laws applicable to: (a) design, development, deployment, implementation, operation, and use of AI technology; (b) any sector or industry in which you or your customers or clients operate; and (c) privacy and data protection.
- Violations of Legal Rights. (a) In any way that compromises or violates the legal rights (including the rights of publicity and privacy) of any person, including by: (i) accessing, collecting, soliciting, processing, disclosing, or sharing personal information in any manner that does not strictly comply with Laws and any disclosures; (ii) conducting unlawful monitoring, tracking, or surveillance of individuals; or (iii) using or distributing digital replicas in any manner that does not strictly comply with Laws, including, without limitation, all disclosure, consent, and authorization requirements imposed by Laws. (b) In any way that you know or should know infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any person.
- Other Prohibited Activities. (a) To deploy techniques that may materially distort an individual or group’s behavior by impairing their ability to make an informed decision in a way that causes or is reasonably likely to cause significant harm. (b) To exploit the vulnerabilities of an individual or group due to their age, disability, or a specific social or economic situation, with the objective, or the effect, of materially distorting their behavior in a manner that causes or is reasonably likely to cause significant harm. (c) For social scoring systems based on social behavior or known, inferred, or predicted personality characteristics that cause detrimental or unfavorable treatment that is disproportionate or used in a context unrelated to the context in which the data was originally collected. (d) For risk-assessment systems that assess the risk of an individual to commit a crime or re-offend (except in support of a human assessment based on verifiable facts). (e) For indiscriminate or untargeted web-scraping for the purposes of creating or enhancing facial recognition databases. (f) For emotion recognition systems in the workplace or educational institutions (except for medical or safety reasons). (g) To categorize individuals or groups based on biometric data or infer characteristics about them such as race, political opinions, religion, or sexual orientation. (h) For real-time, remote biometric identification of individuals in publicly accessible spaces for the purpose of law enforcement.
 
- Additional Restrictions. In addition to the prohibitions set forth in Section 4, you shall not: (a) Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Covered AI Services or any connected or related computer, software, firmware, hardware, device, data, database, system, or network. (b) Violate, attempt to violate, or knowingly facilitate the violation of the security, integrity, or availability of the Covered AI Services or any connected or related computer, software, firmware, hardware, device, data, database, system, or network. (c) Introduce or distribute to the Covered AI Services or use the Covered AI Services to introduce or distribute any viruses, trojan horses, backdoors, malware, worms, logic bombs, malicious code, or other software, device, technology, or material that is malicious or technologically harmful. (d) Circumvent or interfere with features, functionality, filters, or safeguards of the Covered AI Services that are intended to limit or mitigate violations of Laws or this Policy or other harms resulting from use of the Covered AI Services.
- Consents and Disclosures. You agree to disclose your use of the Covered AI Services and obtain consent to use the Covered AI Services as required by, and in accordance with, Laws. Without limiting the foregoing, you agree to disclose: (a) to consumers when they are interacting with an artificial intelligence system if you use the Covered AI Services to interact with consumers or for consumer-facing purposes; (b) your use of the Covered AI Services in connection with any regulated service or service typically performed by a licensed or certified professional; and (c) that any deepfake output has been artificially generated or manipulated.
- Monitoring and Enforcement. We may monitor your use of the Services to evaluate your compliance with this Policy and to investigate any suspected or reported violation by you or your authorized users. Any violation of this Policy by you or your authorized users constitutes a material breach of the Agreement. In addition to our rights under the Agreement, if we, in our sole, reasonable discretion determine that you have violated this Policy, we may: (a) terminate or suspend your access to all or part of the Services, and (b) take appropriate legal action, including without limitation, referral to law enforcement or any authority, for any illegal or unauthorized use of the Services.
- Notices: NOTICE OF HIGH-RISK USE: AI technology, including Generative AI, will continue to be used in new and innovative ways. You are responsible for determining if your use of these technologies is safe.
