  • Use any information or data provided by this site or any GTB representative contacted via this site, or any GTB product and/or service to the detriment of GTB.
Liquidated Damages  You and GTB acknowledge that damages resulting from a breach of this Agreement by You are difficult to determine and/or quantify. Therefore, for each breach of any provision of this Agreement and without prejudice to GTB’s right to seek other remedies at law or in equity You agree to pay to GTB liquidated damages in the amount of USD 500,000.00 (five hundred thousand). Additional claims by GTB resulting from the breach of these provisions remain unaffected. Such liquidated damages will be set off against any other damage awards to GTB resulting from the breach.

Warranties and Disclaimers; Liability Limitations

Indemnification

Release 

In the event that you have a dispute with one or more Site users, you release GTB (and our officers, directors, agents, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

Governing Law and Jurisdiction
