Use of the software, knowledge bases, and/or documentation is governed by the most current version of the end-user license, the “Evaluation Terms and Conditions” Agreement which shall be located at GTB Terms & Conditions

You should not attempt to use, download, or install any software or documentation unless you agree to the terms of the above-mentioned Terms and Conditions Agreement.  You will not be authorized to use, download, or install any software or documentation unless you have agreed to the above-mentioned Evaluation Terms and Conditions Agreement.

  • Conduct any stress tests, competitive benchmarking, or analysis on, or publish, disclose, divulge, or otherwise make available, including but not limited to benchmark results, vulnerability scans and/or tests, comparison results of any kind, or performance test results to any third party.
  • Use any information or data provided by this site or any GTB representative contacted via this site, or any GTB product and/or service to the detriment of GTB.

Liquidated Damages

 You and GTB acknowledge that damages resulting from a breach of this Agreement by You are difficult to determine and/or quantify. Therefore, for each breach of any provision of this Agreement and without prejudice to GTB’s right to seek other remedies at law or in equity You agree to pay to GTB liquidated damages in the amount of USD 500,000.00 (five hundred thousand). Additional claims by GTB resulting from the breach of these provisions remain unaffected. Such liquidated damages will be set off against any other damage awards to GTB resulting from the breach.

Warranties and Disclaimers; Liability Limitations




Use of this Site is at your own risk, and GTB is not liable for any direct, indirect, special, incidental, or consequential damages arising out of the attempt to use this website and/or the use of materials on this Site. This includes but is not limited to the loss of data or loss of profit.

To the fullest extent permitted by law, you shall indemnify, defend and hold harmless GTB, its licensors/suppliers and their respective officers, directors, employees and agents from any and all claims (including without limitation any proceeding, investigation or claim by a self-regulatory organization, state or federal securities agency or commission), demands, damages, costs and liabilities, including reasonable attorneys’ fees, arising out of or in connection with: (1) any of your Contributions, including an assertion that the information, content, or other materials or services provided or made available by you or the use thereof, may infringe any copyright, trademark, or other intellectual property rights of any individual or entity, or misappropriate any individual or entity’s trade secret, or contain any libelous, defamatory, disparaging, pornographic, or obscene materials; (2) any breach by you of your obligations under these Terms including the Rules of Conduct set forth in the Section titled “Rules of Conduct” (3) your unlawful and/or unauthorized use of, or activities in connection with this Site. The foregoing indemnities shall survive the expiration or termination of these Terms.


In the event that you have a dispute with one or more Site users, you release GTB (and our officers, directors, agents, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

Trademarks And Intellectual Property Rights

Any trademarks, logos, and service marks (“Marks”) displayed on our Site are the property of GTB and/or other third parties. You may not use these Marks without the prior written consent of GTB and/or such third party that may own the Mark.

You hereby acknowledge all rights, titles, and interests, including but not limited to, rights covered by the Intellectual Property Rights, in and to the Site, GTB products and / or services and that you will not acquire nor attempt to acquire any right, title, or interest in or to the Site, GTB products and / or services. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or documentation, or create or attempt to create a substitute or similar service or product through the use of or access to the Site or proprietary information related thereto.
